2) Eligibility and age requirement
You must be at least 17 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
3) The Service
Timoo is a professional photography critique app powered by AI. You can upload your photos and receive comprehensive photography analysis including composition evaluation, lighting critique, and professional shooting suggestions.
The Service may change over time. We may add, remove, or modify features to maintain security, improve performance, comply with law, or reflect changes in our offerings.
4) Account registration and security
You may need an account to use certain features. When you register, you may provide name, username, and email address.
- Accuracy: you agree to provide accurate information and keep it up to date.
- Security: you must keep credentials confidential and promptly notify us of any unauthorized access.
- Responsibility: you are responsible for activities under your account unless caused by our negligence or security failure.
5) User content and permissions
“User Content” means any content you submit to the Service, including photos, text prompts, comments, and support messages.
You retain ownership of your User Content. To operate the Service, you grant Timoo Team a limited, non-exclusive, worldwide, royalty-free license to host, store (transiently), reproduce, process, and transmit your User Content solely to provide the Service to you (including generating AI critiques and results you request), maintain and secure the Service, and troubleshoot issues.
This license ends when your User Content is deleted from our systems, except that we may retain limited records as required by law or for legitimate security purposes.
6) AI outputs, limitations, and your responsibility
The Service produces AI-generated critiques and suggestions (“Outputs”). Outputs are based on your inputs and automated analysis.
- Informational only: Outputs may be incomplete, incorrect, or not applicable.
- Your responsibility: you are responsible for how you use Outputs and for verifying recommendations.
- No guarantee: we do not guarantee accuracy, completeness, or usefulness of Outputs.
7) Prohibited conduct
- Illegal use or violation of applicable law.
- Uploading content you do not have the rights to use; infringement of IP or privacy rights.
- Uploading or generating unlawful content, including hateful or harassing content.
- Reverse engineering, decompiling, or attempting to access underlying systems except as permitted by law.
- Unauthorized access attempts, disruption, or interference with the Service.
- Automated access that degrades performance or circumvents rate limits.
8) Privacy
Your privacy matters. Our privacy practices are described in our Privacy Policy, which explains what we collect, how we use it, and your choices.
9) Intellectual property
The Service (excluding User Content) is owned by Timoo Team or its licensors and is protected by applicable intellectual property laws.
You receive a limited, personal, non-transferable, non-exclusive, revocable license to use the Service for your own lawful purposes in accordance with these Terms.
10) Feedback
If you provide suggestions or feedback, you grant us the right to use it without restriction or compensation to improve the Service. This does not give us ownership of your User Content.
11) Termination
You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, your use creates security/legal risk, or we are required to do so by law.
Upon termination, your right to use the Service ends. Sections that by their nature should survive termination will survive.
12) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” To the maximum extent permitted by law, Timoo Team disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
13) Limitation of liability
To the maximum extent permitted by law, Timoo Team will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service or Outputs.
In no event will Timoo Team’s total liability exceed the amount you paid to Timoo Team for the Service in the 12 months before the event giving rise to the claim (or, if you paid nothing, USD $50), to the extent permitted by law.
14) Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice through the Service or by other means. Continued use after the effective date constitutes acceptance.
15) Governing law and dispute resolution (binding arbitration)
These Terms are governed by the laws of Timoo Team’s principal place of business, without regard to conflict of laws principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis, and not in a class, consolidated, or representative action, except where prohibited by law.
Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction for unauthorized use of intellectual property or to protect confidential information, where such relief is available.
